Surcharges for DWI Convictions

SURCHARGES FOR DWI CONVICTIONS IN TEXAS

According to the Driver Responsibility Program passed by the Texas Legislature to become effective on September 1, 2003, certain surcharges must be paid by any Defendant convicted to Driving While Intoxicated.

First Offense DWI: Upon conviction, the amount of surcharge that must be paid is $1,000.00 per year for three years for a total of $3,000.00.

Second Offense DWI or Subsequent Conviction: Upon conviction, the amount of surcharge that must be paid is $1,500.00 per year for three years for a total of $4500.00.

Breath, blood or urine specimen of alcohol concentration level of 0.16 or more. If it is shown on the trial of the DWI offense that an analysis of a specimen of the person’s breath, blood or urine showed an alcohol concentration level of 0.16 or more, then the surcharge is $2,000.00 per year for three years for a total of $6,000.00

Failure to pay these surcharges will result in a driver’s license suspension and the license will remain suspended until the person pays the full amount of the surcharge.
